May 2nd, 2010 by OlgaThe ocean users’ community will hold a meeting on Tuesday, May 4, 2010. The meeting will take place at 6:30 PM at the Hawaii Yacht Club. The meeting agenda will include updates and discussion regarding plans to redevelop certain areas of the Ala Wai Harbor and plans of the Hilton Hawaiian Village to build two additional towers, among other things. These developments could have implications for the Ilikai. Try to attend this May 4, 2010 meeting. It is our opportunity to network with other active members of the community and coordinate and join efforts. Be there!
Proposed “Waikiki Landing” Development for Ala Wai Harbor, PUBLIC COMMENTS ARE DUE BY MAY 23, 2010

IMPORTANT ACTIONABLE ITEMS: (1) The public can and is invited and encouraged to submit comments regarding this proposed development and the corresponding Draft Environment Assessment. The due date for comments is May 23, 2010. As said, the deadline is May 23, 2010.

April 12th, 2010 by OlgaAs reported earlier, several Bills are going through this year’s Hawaii State Legislature that could be of relevance to us at the Ilikai. This includes several Bills that include the Ala Wai Harbor in their scopes. Here is a detailed update as of today, April 12, 2010, regarding the status of these Bills and what you can do. This update was put together and so kindly supplied to us by Makai Society that is representing members of the ocean use community. The current status is this (thanks to Makai Society for this update!). Conference Committee (CC) members have been selected. Each bill has its own set of CC members (fortunately, HB 2582 and HB 2741 the Senate members are the same). As Makai Society advises based on their experience working with the Legislature, all CC members are not equal. So if you have limited time, then concentrate your efforts on the Chair and Co-chairs of the CCs. During the next 4-5 days (i.e., this week!), the Chairs and Co-chairs must reach agreement on the final language in each bill or the bill dies. If and when they agree then each chamber must vote on each finalized bill. Approved bill(s) then go to the governor for her signature.
Is there anything you can do to influence those decisions? Yes! There are no more hearings for public testimonies. At this point, the most effective method to influence the CCs’ decision is in-person by visiting their offices. Write some brief comments on a single sheet of paper so if the CC member is not in the office, you can leave a copy of your comments with their office staff. The second best method is by phone. Third is e-mail. Friends and family can help, too, especially if they live in one of the Chairs’ districts.
IMPORTANT: Liquor license application for the Yacht Harbor Tower
April 12th, 2010 by OlgaThe Marriott Hotel Services is in the process of obtaining a liquor license for the Yacht Harbor Tower. They are scheduled to present their case at the upcoming meeting of the Waikiki Neighborhood Board tomorrow, April 13, 2010, at 310 Paoakalani Avenue 7:00-9:30 PM. Click here to view the agenda for the meeting. The “Liquor License for Former Yacht Harbor Tower at the Ilikai” item is listed on the agenda for 9:05 PM. Generally, they stick with the agenda’s timeline, so attendees interested in certain items do not necessarily need to be there for the entire meeting.
Then the next step would be a public hearing held by the Liquor Commission regarding this application. This hearing is scheduled for Thursday, April 22, 2010 at 4 PM, at the office of the Commission on the 6th floor of the Pacific Park Plaza, 711 Kapiolani Blvd, Honolulu, HI 96813. A couple of comments re this. This application is for the upcoming Edition Hotel that is scheduled to open at the Yacht Harbor Tower. There is A LOT of excitement and enthusiasm about the Edition Hotel. It is terrific news and we look forward to this!
Having said that, one needs to consider practical issues and learn lessons from what is happening now on the Hilton Hawaiian Village side of the Ilikai. For over a year already, hundreds of Ilikai owners and visitors on that side have been victims of the terrible noise coming from the Hilton Luau. Following numerous complaints to the Liquor Commission, the Commission’s investigators measured the noise level, documented that it was over permitted levels, cited Hilton, and Hilton paid some fines (a drop in a bucket by their standards). The luau and noise continue. Multiple Ilikai owners tried for months to convince the previous Board of Directors of the AOAO to intervene. That Board’s position was, “It is your personal problem.” How could it be a personal problem when it is affecting 1/3 of the building? We don’t know yet the position of the current Board (the new Board is of March 2010). With the new Board there is new hope.
Back to the YHT: One could look into making sure this liquor license has certain parameters. It is much easier to prevent this type of problems than to try to solve them later on. But if you are an Ilikai owner on the Harbor side and counting on the Board of Directors and the AOAO legal counsel to take care of this and to protect your interests while you can sit back and relax, then, in my opinion, you are living in a fantasy world.
From what I hear, some Ilikai owners are planning to attend both the Waikiki Neighborhood Board and the Liquor Commission meetings. You may be able to car-pool.

SB 2402 – a Legislative Bill of potential concern to condominium owners
April 12th, 2010 by OlgaThe 2010 Hawaii State Legislature is wrapping up its session. We previously reported on several Bills of relevance, such as the ones applicable to the Ala Wai Harbor. Here is another Bill that could be of concern. If the original SB 2402 gets passed, then 37 transactions now exempt from the general excise tax (GET) would be subject to a 1% GET. These include gross income generated by nonprofit organizations from certain conventions, etc, and – of relevance to us – maintenance fees paid to condominium associations. Here is a link to a April 7, 2010 article in Star Bulletin about this. There are though reports of proposals to trim down that list of 37 transactions. Representative Tom Brower (Waikiki, Ala Moana, Kakaako), whose district consists of approx. 95% condominiums and cooperatives, introduced on April 6 a floor amendment to remove from the 1% increase in taxation one of the 37 classes the current bill would tax: condominium maintenance and homeowners fees. Apparently, the state’s actual and aspiring leaders have been promoting this idea for years already, incl. during much better economic times. “It’s like déjà vu all over again.”

Since we are on this subject, here is some information about the Ala Wai Harbor for readers who are not as familiar with the area. The Ala Wai Harbor is a small boat and yacht harbor in Honolulu, HI. Situated at the mouth of the Ala Wai Canal, it separates Waikiki and downtown Honolulu. The harbor hosts 700 berths, 85 moorings, 1 boat ramp, and 20 dry storage spaces.
Our Ilikai as well as the Hawaii Prince Hotel Waikiki and Hilton Hawaiian Village are located adjacent to this harbor, with views of the harbor from many of the rooms. The TransPac sailing race is a very big event that takes place every two years; the race begins in Los Angeles and ends at the Ala Wai Harbor. The harbor has the Ala Wai Harbor Waikiki Yacht Club and the Hawaii Yacht Club.
